A BILL FOR AN ACT

 

 

relating to agriculture.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 141, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§141-    Farm leases.  (a)  Notwithstanding any provisions in chapter 171 to the contrary, the department may enter into leases with qualified farmers to lease land under its jurisdiction for the purpose of food production.

     (b)  Leases entered into under this section shall:

     (1)  Be leased at a rate of        per cent less than the market rate for similar land; and

     (2)  Contain provisions for the immediate eviction of lessees who do not abide by the terms of the lease.

     (c)  For purposes of this section, "qualified farmer" means a person of proven farming ability who is presently devoting, has recently devoted, or intends to devote most of the person's time or who derives a major portion of the person's income from direct participation in farming in its broadest sense.

     (d)  The department shall adopt rules pursuant to chapter 91 to administer and implement this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
