A BILL FOR AN ACT

 

 

relating to dogs.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 707, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§707-    Negligent failure to control a dog.  (1)  A person commits the offense of negligent failure to control a dog if:

     (a)  The person is the owner of a dog;

     (b)  The dog bites another person and causes serious bodily injury; and

     (c)  The dog, at the time of the offense, is:

          (i)  Unleashed; or

         (ii)  On private property without the consent of the owner of that property.

     (2)  Negligent failure to control a dog is a petty misdemeanor unless the defendant has two or more convictions for negligent failure to control a dog, in which case it is a misdemeanor."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
