A BILL FOR AN ACT

 

 

RELATING TO AGRICULTURE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There is established an agricultural genetically modified organism task force to determine whether the State should regulate the agricultural use of genetically modified organisms.  The task force shall be attached to the department of agriculture for administrative purposes.

     (b)  The task force shall comprise the following members, or their designees:

     (1)  The University of Hawaii vice president for research and innovation, who shall serve as chairperson;

     (2)  The chairperson of the board of agriculture;

     (3)  The director of health; and

     (4)  Four experts with scientific knowledge in the use of genetically modified organisms in agriculture, to be selected by the governor.

     (c)  The chairperson of the task force shall invite the following stakeholders to serve as members:

     (1)  The President of the Hawaii Farm Bureau Federation, or the President's designee;

     (2)  The President of the Hawaii Farmers Union United, or the President's designee; and

     (3)  Any other stakeholders that the chairperson of the task force deems appropriate.

     (d)  The agricultural genetically modified organism task force shall:

     (1)  Analyze the benefits and drawbacks of establishing state regulations for agricultural genetically modified organisms; and

     (2)  Make recommendations on the structure of a regime that should be established to regulate the use of agricultural genetically modified organisms if the task force determines that state regulation is needed.

     (e)  The attorney general shall provide legal advice and assistance to the task force at the request of the task force.

     (f)  The members of the task force shall serve without pay but shall be reimbursed for their actual and necessary expenses, including travel expenses, incurred in carrying out their duties.

     (g)  The task force shall report its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2016 and shall be dissolved on June 30, 2016.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2014-2015 for administrative costs associated with the agricultural genetically modified organism task force.

     The sum appropriated shall be expended by the University of Hawaii for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2050.
