A BILL FOR AN ACT

 

 

relating to dental specialists.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 448, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§448-    Specialty dentists; licensure.  (a)  The board of dental examiners may issue a specialty license in the specialty areas of dentistry that are recognized by the American Dental Association.

     (b)  An applicant for a specialty license shall:

     (1)  Have graduated from an accredited dental specialty education program in dental public health, endodontics, oral and maxillofacial surgery, oral and maxillofacial pathology, oral and maxillofacial radiology, orthodontics and dentofacial orthopedics, pediatric dentistry, periodontics, or prosthodontics;

     (2)  Submit to the board a completed application and all required fees;

     (3)  Submit to the board verification of:

         (A)  Graduation from a general dental education program accredited by the American Dental Association Commission on Dental Accreditation;

         (B)  Graduation from or a certification of completion from a post-graduate specialty program accredited by the Commission on Dental Accreditation of the American Dental Association.  Additional acceptable documentation may include verification of holding a diplomate status from a dental specialty certifying board recognized by the American Dental Association, as provided in American Dental Association policy;

         (C)  A current active license issued by another state that is not revoked, suspended, or otherwise restricted;

         (D)  Having been lawfully engaged in the practice of dentistry in the applicant's dental specialty for at least two years preceding the date of the application, with a minimum of one thousand hours of practice in the dental specialty each year;

         (E)  Completion of a minimum of thirty-two hours of continuing education in the applicant's dental specialty within the preceding two year period; and

         (F)  Not having been subject to disciplinary action by any jurisdiction in which the applicant is or has been previously licensed to practice dentistry; provided that if the applicant has been subject to disciplinary action, the board shall review that action to determine if it warrants refusal to issue a license to the applicant;

     (4)  Have passed all appropriate components of the National Dental Board examinations; and

     (5)  Abide by professional ethical conduct requirements.

     (c)  A specialty dentist holding a specialty license shall be limited to practicing in the dentist's designated specialty area.  The scope of practice shall be defined by each national specialty board recognized by the American Dental Association.

     (d)  A specialty dentist holding a general dentist license shall be limited to practicing in the dentist's designated specialty area if the dentist has announced a limitation of practice.  The scope of practice shall be defined by each national specialty board recognized by the American Dental Association.

     (e)  All specialty dentists who have fulfilled the specialty dentist requirements and who intend to limit their practice to a particular specialty area may apply for a specialty license."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
