A BILL FOR AN ACT

 

 

relating to law enforcement.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 52D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§52D-    Body cameras; requirements.  (a)  The police commission of each county shall develop basic guidelines for the use of body cameras by police officers.  The guidelines shall developed by the police commission of each county shall be the basis for the written policy that shall be adopted by each county police department that uses police officer worn body cameras.

     (b)  The written policy regarding police officer worn body cameras shall include but not be limited to procedures relating to the following:

     (1)  Body camera specifications, including recording capabilities;

     (2)  Body camera training for police officers, including proper care and maintenance of the body cameras;

     (3)  Body camera use during police officer on-duty and off-duty activity and body camera storage;

     (4)  Notice requirements regarding body camera use; and

     (5)  Access to, confidentiality, and storage requirements of body camera recordings.

     (c)  Each county police department that uses police officer worn body cameras shall submit a written annual report to its respective police commission on or before May 1 of each year.  The report shall include but not be limited to:

     (1)  A brief overview of the police department, including the number of police officers using body cameras;

     (2)  Any technical issues with the equipment and how those issues were remedied, if applicable;

     (3)  A brief description of the review process used by supervisors with the police department;

     (4)  Data regarding body camera recordings used in prosecutions of criminal or traffic offenses or county ordinance violations; and

     (5)  Any other information relevant to the administration of police officer worn body camera program.

On or before July 31 of each year, each county police commission shall analyze the written annual reports and submit a written annual report to the department of the attorney general and legislature.

     (d)  Each county police department shall explore and apply for any available federal funding and grant moneys to assist in covering the operational costs of employing a police officer worn body camera program.  The police department may request and use state matching funds upon securing federal funding or grant moneys.

     (e)  For purposes of this section:

     "Body camera" mean an electronic camera system for creating, generating, sending, receiving, storing, displaying, and processing audiovisual recordings that may be worn on a police officer's body.

     "Recording" means the process of capturing data or information stored on a body camera."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
