A BILL FOR AN ACT

 

 

RELATING TO EDUCATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Act 214, Session Laws of Hawaii 2011, is amended by amending section 1 to read as follows:

     "SECTION 1.  (a)  The board of education shall monitor the department of education for compliance with any department of education administrative rules or statutes governing bullying, cyberbullying, and harassment.

     (b)  The board of education shall establish reporting requirements for the department of education to report to the board of education on the department of education's compliance with any department of education administrative rules or statutes governing bullying, cyberbullying, and harassment.

     (c)  The department of education shall establish, after statewide consultation with teachers, parents, and students, procedures for public high school students to amicably and peacefully resolve amongst themselves student complaints concerning bullying, cyberbullying, and harassment.

     (d)  Each public high school shall establish an anti-bullying council that shall:

     (1)  Inform students of the high school of the negative effects of bullying, cyberbullying, and harassment; and

     (2)  Preside over procedures, established by the department of education pursuant to subsection (a), to resolve student complaints in an amicable and peaceful manner.

Each anti-bullying council shall consist entirely of students of the particular high school; provided that each public high school shall determine the method of selection of members of the council for that high school; provided further that the principal or vice-principal of the high school shall serve as a faculty adviser to each council."

     [(c)] (e)  As used in this Act, "bullying", "cyberbullying", and "harassment" shall have the same meanings as defined in any department of education administrative rules or statutes governing bullying, cyberbullying, and harassment."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.


     SECTION 3.  This Act shall take effect on October 1, 2012.
