A BILL FOR AN ACT

 

 

relating to HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the forensic mental health system provides essential and critically important services to the judiciary, public mental health system, and community.

     As outlined in chapter 704, Hawaii Revised Statutes, forensic mental health evaluators perform evaluations on defendants charged with criminal conduct to determine competency to stand trial, criminal responsibility, and post-acquittal conditional release evaluations.  The evaluations are conducted in the state hospitals, in jails and prisons, and in the community, and are utilized by the courts in the administration and disposition of mentally ill individuals in the public health and safety community.

     Education and training of forensic mental health evaluators are necessary to provide leadership and ensure the quality and professionalism of these services.  The in-demand skillsets that are necessary to meet the needs of society will necessitate the ongoing availability of educated and trained licensed forensic mental health professionals in psychology and psychiatry.

     The legislature finds it essential to establish a credentialed post doctoral training program for psychology and forensic psychiatry to be based and administered in the department of health, with service components in various mental health and public safety agencies and educational institutions in the community.  The fellowship will meet certain requirements for licensure in psychology and the requirements for board certification by the American Board of Forensic Psychology and the American Board of Psychiatry and Neurology.

     SECTION 2.  Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§321-    Post doctoral fellowship; forensic psychiatry and psychology.  The department of health shall establish a credentialed post doctoral training program for psychology and forensic psychiatry with service components in various mental health and public safety agencies and educational institutions in the community.  The fellowship shall be developed to satisfy the following requirements:

     (1)  Section 465-7(a)(2) for licensure as a psychologist;

     (2)  Board certification from the American Board of Forensic Psychology; and

     (3)  Board certification from the American Board of Psychiatry and Neurology certification in forensic psychiatry."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $600,000 or so much thereof as may be necessary for fiscal year 2016-2017 for the development and funding of the post doctoral fellowship in psychology and forensic psychiatry, including funding for program development, instruction, and educational stipends for the fellows.

     The sum appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2016.
