TWENTY-FIFTH LEGISLATURE, 2010
STATE OF HAWAII

A BILL FOR AN ACT

relating to public trust lands.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 10, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§10- Public trust lands transfer. The management, control, and title of all unencumbered lands described in article XII, section 4 of the state constitution, as lands held in the public trust, shall be transferred to the sovereign native Hawaiian entity upon its recognition by the United States and the State of Hawaii."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
