A BILL FOR AN ACT
relating to illegal vacation rentals.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 28, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§28- Illegal vacation rental enforcement
revolving fund. (a) There is established in the state treasury
the illegal vacation rental enforcement revolving fund, into which shall be
deposited:
(1) Appropriations
made by the legislature; and
(2) Moneys
recovered by the counties in the course of illegal vacation rental enforcement
investigations in the amount distributed to the counties pursuant to subsection
(b); provided that fifty per cent of moneys recovered by the counties shall
remain in the illegal vacation rental enforcement revolving fund to be
distributed to the counties pursuant to subsection (b) and fifty per cent of
moneys recovered by the counties shall be deposited into the general revenues
of the State of Hawaii.
(b) The illegal vacation rental enforcement
revolving fund shall be administered by the department of the attorney general
and moneys from the fund shall be distributed at the request of the counties
and used to make rental deposits in investigations of persons operating illegal
vacation rental units in violation of county ordinances, rules, and
regulations.
(c) The department of the attorney general shall submit a report to the legislature no later than twenty days prior to the convening of each regular session to provide an accounting of the receipts and expenditures of the fund."
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2018-2019 to be deposited into the illegal vacation rental enforcement revolving fund.
SECTION 3. There is appropriated out of the illegal vacation rental enforcement revolving fund the sum of $ or so much thereof as may be necessary for fiscal year 2018-2019 for rental deposits made by the counties in the course of investigations of persons operating illegal vacation rental units in violation of county ordinances, rules, and regulations.
The sum appropriated shall be expended by the department of the attorney general for the purposes of this Act.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect on July 1, 2018.
