A BILL FOR AN ACT

 

 

relating to prescription medications.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 431, Hawaii Revised Statutes, is amended by adding a new section to article 10A to be appropriately designated and to read as follows:

     "§431:10A-    Prescription medications; opioid dependency; copayment or coinsurance; exemption.  (a)  Each policy of accident and health or sickness insurance issued or renewed in this State that provides prescription drug coverage shall exempt prescriptions for opioid dependency treatment medications from any copayment or coinsurance provisions that may apply to those prescriptions in the policy.

     (b)  This section shall not apply to limited benefit health insurance as provided pursuant to section 431:10A-102.5.

     (c)  For the purposes of this section:

     "Buprenorphine" means a schedule III drug included in section 329-18, which is used in the treatment of opioid dependency.

     "Naloxone" means a prescription medication approved by the federal Food and Drug Administration that is used in the treatment of opioid dependency.

     "Opioid dependency treatment medications" means:

     (1)  Naloxone; or

     (2)  Prescription medications that contain buprenorphine and naloxone as active ingredients and are used in the treatment of opioid dependency."

     SECTION 2.  Chapter 432, Hawaii Revised Statutes, is amended by adding a new section to article 1 to be appropriately designated and to read as follows:

     "§432:1-    Prescription medications; opioid dependency; copayment or coinsurance; exemption.  (a)  Each individual and group hospital or medical service plan contract issued or renewed in this State that provides prescription drug coverage shall exempt prescriptions for opioid dependency treatment medications from any copayment or coinsurance provisions that may apply to those prescriptions in the plan contract.

     (b)  This section shall not apply to limited benefit health insurance as provided pursuant to section 431:10A-102.5.

     (c)  For the purposes of this section:

     "Buprenorphine" means a schedule III drug included in section 329-18, which is used in the treatment of opioid dependency.

     "Naloxone" means a prescription medication approved by the federal Food and Drug Administration that is used in the treatment of opioid dependency.

     "Opioid dependency treatment medications" means:

     (1)  Naloxone; or

     (2)  Prescription medications that contain buprenorphine and naloxone as active ingredients and are used in the treatment of opioid dependency."

     SECTION 3.  Chapter 432D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§432D-    Prescription medications; opioid dependency; copayment or coinsurance; exemption.  (a)  Each policy, contract, plan, or agreement issued or renewed in this State that provides prescription drug coverage shall exempt prescriptions for opioid dependency treatment medications from any copayment or coinsurance provisions that may apply to those prescriptions in the policy, contract, plan, or agreement.

     (b)  This section shall not apply to limited benefit health insurance as provided pursuant to section 431:10A-102.5.
