A BILL FOR AN ACT

 

 

A BILL PROPOSING AN AMENDMENT TO THE HAWAII CONSTITUTION RELATING TO EDUCATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to propose an amendment to the Constitution of the State of Hawaii to transfer the authority to appoint the superintendent of education from the board of education to the governor.

     SECTION 2.  Article X of the Constitution of the State of Hawaii is amended by adding a new section to be appropriately designated and to read as follows:

     "Section   .  The superintendent of education shall be nominated and, by and with the advice and consent of the senate, appointed by the governor, for a term to expire at the end of the term for which the governor was elected.  The superintendent of education shall be the chief executive officer of the public school system."

     SECTION 3.  Article X, section 3, of the Constitution of the State of Hawaii is amended to read as follows:

"POWER OF THE BOARD OF EDUCATION

     Section 3.  The board of education shall have the power, as provided by law, to formulate statewide educational policy [and appoint the superintendent of education as the chief executive officer of the public school system]."

    SECTION 4.  The question to be printed on the ballot shall be as follows:

    "Shall the state constitution be amended to transfer the power to appoint the superintendent of education from the board of education to the governor?"

     SECTION 5.  Constitutional material to be repealed is bracketed and stricken.  New constitutional material is underscored.

     SECTION 6.  This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
