A BILL FOR AN ACT

 

 

relating to electronics.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the use of electronic devices has grown substantially over the past two decades, and according to the United States Environmental Protection Agency, Americans have generated approximately three million tons of waste in consumer electronics goods per year during the last decade.

     The legislature further finds that while recycling of electronic devices prevents valuable materials from going into the waste stream, preventing waste in the first place is preferable to any waste management option.  Further, reusing items, such as electronic devices, is also beneficial and can save state government in costs associated with purchasing new devices or equipment when items can be reused or refurbished instead.

     The purpose of this Act is to establish a reuse policy working group to propose legislation on implementing a policy for state departments and agencies to reuse certain items such as electronic devices.

     SECTION 2.  (a)  There is established within the department of accounting and general services for administrative purposes the reuse policy working group.

     (b)  The working group shall propose legislation on implementing a policy for state departments and agencies to reuse certain items such as electronic devices.

     (c)  The membership of the working group shall be as follows:

     (1)  The administrator of the state procurement office or the administrator's designee, who shall serve as chair;

     (2)  The director of accounting and general services or the director's designee;

     (3)  A representative from the department of the attorney general;

     (4)  A representative from the department of education;

     (5)  A representative from the office of enterprise technology services;

     (6)  A representative from the refurbishing industry;

     (7)  A representative from the recycling industry;

     (8)  A representative from the electronics industry;

     (9)  A representative from an environmental nonprofit organization;

    (10)  A legislator representing each county, to be selected jointly by the President of the Senate and the Speaker of the House of Representatives; and

    (11)  Any individual or entity recommended by the working group.

     (d)  The working group is subject to chapter 92, Hawaii Revised Statutes.

     (e)  The members of the working group shall serve without compensation but shall be reimbursed for expenses, including travel expenses, necessary for the performance of their duties.

     (f)  No member of the working group shall be made subject to chapter 84, Hawaii Revised Statutes, solely because of that member's participation in the working group.

     (g)  The working group shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2023.

     SECTION 3.  The working group shall dissolve on June 30, 2023.

     SECTION 4.  This Act shall take effect upon its approval.
