A BILL FOR AN ACT
relating to eyewitness identifications.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Act 281, Session Laws of Hawaii 2019, is repealed.
SECTION 2. Nothing in this Act shall be construed to diminish or abrogate the court's authority and duty to ensure that any eyewitness identification considered by a jury meets all applicable legal standards for reliability, under the totality of the circumstances.
SECTION 3. This Act shall take effect upon its approval.
