A BILL FOR AN ACT

 

 

RELATING TO INTOXICATING LIQUOR.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 712-1250.5, Hawaii Revised Statutes, is amended by amending subsection (4) to read as follows:

     "(4)  Promoting intoxicating liquor to a person under the age of twenty-one is a petty misdemeanor.  Any person convicted of violating this section shall be sentenced as follows:

     (a)  For a first conviction, the person shall serve a minimum term of imprisonment of no less than twenty-four hours;

     (b)  For a second conviction within five years, the person may serve a term of imprisonment of no fewer than twenty days; and

     (c)  For a third or subsequent conviction within five years, the person may serve a term of imprisonment of no fewer than thirty days."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.

Changes classification of the offense of promoting intoxicating liquor to a minor from misdemeanor to a petty misdemeanor.  Requires a minimum 24-hour imprisonment for the first offense.  Authorizes longer imprisonment term for second, third, and subsequent offenses.
