A BILL FOR AN ACT

 

 

RELATING TO EDUCATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to repeal section 302A-305, Hawaii Revised Statutes, relating to the education research and development revolving fund pursuant to the recommendation made by the auditor in auditor's report no. 16-11.  The legislature finds that the fund does not meet the self-sustaining criteria for a revolving fund and should be repealed.

     SECTION 2.  Section 302A-305, Hawaii Revised Statutes, is repealed.

     ["[§302A-305]  Education research and development revolving fund.  (a)  There is established, within the department of education, an education research and development revolving fund into which shall be deposited all revenues from the commercial exploitation of products and services developed by the department.  The fund shall be used to support research and development of innovative curriculum, instructional aids, related technologies, and the related administrative costs of seeking and maintaining such commercialization.  Appropriations or authorizations from the fund shall be expended by the superintendent.

     (b)  The department shall provide an annual report to the governor and the legislature describing all transactions and activities involved in the administration of the education research and development revolving fund."]

     SECTION 3.  On July 1, 2017, all unencumbered balances remaining in the education research and development revolving fund repealed by section 2 of this Act shall lapse to the credit of the general fund.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.

     SECTION 5.  This Act shall take effect on July 1, 2017.
