A BILL FOR AN ACT
relating to health.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 149A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§149A- Use of glyphosate prohibited. No product containing any amount of glyphosate shall be sold, transferred, distributed, or used within the State until July 1, 2019."
SECTION 2. Section 149A-2, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:
""Glyphosate" means a synthetic compound that is a non-selective systemic herbicide, also known as N-(phosphonomethyl) glycine with a chemical formula of C3H8NO5P."
SECTION 3. (a) There shall be established within the department of health for administrative purposes a glyphosate working group.
(b) The working group shall consist of the following members:
(1) The director of health, or the director's designee;
(2) The chairperson of the board of agriculture, or the chairperson's designee;
(3) A representative from the University of Hawaii college of tropical agriculture and human resources;
(4) The chairperson of the board of land and natural resources, or the chairperson's designee;
(5) A representative from the Hawaii Farm Bureau Federation;
(6) A representative from the pesticide industry, to be appointed by the governor; and
(7) A representative from an environmental organization, to be appointed by the governor.
(c) The working group shall:
(1) Research and identify any health and safety concerns associated with the use of glyphosate;
(2) Identify safe alternatives to glyphosate;
(3) Determine whether the use of glyphosate should be permitted in the State; and
(4) If the use of glyphosate should be permitted, identify recommended safe practices associated with the use of glyphosate.
(d) The members of the working group shall serve without compensation but shall be reimbursed for expenses, including travel expenses, necessary for the performance of their duties.
(e) The members of the working group shall submit a report of the working group's findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2019.
(f) The glyphosate working group shall cease to exist on June 30, 2019.
SECTION 4. New statutory material is underscored. SECTION 5. This Act shall take effect on July 1, 2014.
