A BILL FOR AN ACT

 

 

RELATING TO CAPITAL IMPROVEMENT PROJECTS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 103, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§103-     Capital improvement projects; professional services; limit on expenditures.  (a)  For any capital improvement project authorized in the State, no more than fifteen per cent of the total project budget shall be expended for professional services.

     (b)  For the purposes of this section:

     "Professional services" has the same meaning as in section 103D-104.

     "Total project budget" means the total amount of moneys authorized or appropriated for a capital improvement project, including moneys authorized for the same capital improvement project in prior fiscal years.  "Total project budget" includes all moneys authorized for planning, land acquisition, design, construction, and equipment and furnishing."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
