A BILL FOR AN ACT

 

 

proposing an amendment to article xi of the hawaii state constitution to preserve the individual right to fish and hunt.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to propose an amendment to article XI of the Constitution of the State of Hawaii to recognize hunting and fishing as a protected individual right.

     SECTION 2.  Article XI of the Constitution of the State of Hawaii is amended by adding a new section to be appropriately designated and to read as follows:

"HUNTING AND FISHING RIGHTS

Section   .  Each person shall have the right to hunt and fish subject to reasonable limitations and regulations as provided by law.  The recognition of this right shall not abrogate any private or public property rights nor limit the State's powers to conserve and protect all of Hawaii's natural resources."

    SECTION 3.  The question to be printed on the ballot shall be as follows:

    "Shall hunting and fishing be protected as an individual right subject to reasonable limitations and regulations as provided by law?" 

     SECTION 4.  New constitutional material is underscored.

     SECTION 5.  This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
