TWENTY-FIFTH LEGISLATURE, 2010
STATE OF HAWAII

A BILL FOR AN ACT

 

 

RELATING TO SMOKING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  Chapter 328J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§328J‑    Smoking prohibition; bus stops, beaches, parks. (a)  Smoking shall be prohibited as follows:

     (1)  At public bus stops; provided that the prohibition shall extend to a distance of       feet surrounding the bus stop;

     (2)  On beaches; and

     (3)  At public parks.

     (b)  As used in this section:

     "Public bus stops" means stops along bus routes to pick up and drop off riders of a bus that is operated by a county for public transportation.

     "Public parks" means any park, park roadway, playground, athletic field, or beach right-of-way that is under the control, maintenance and management of the State or a county."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
