A BILL FOR AN ACT
RELATING TO private ROADs.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that there are many roads throughout the State that are not owned by the State or a county and whose private ownership is unknown. Historically, these roads may have been indicated on a subdivision plat or came about as a remnant of a former road or a small portion of a larger public road. Although these roads are often used by and benefit the public, the roads do not receive necessary repair and maintenance and in some situations have fallen into great disrepair.
The legislature also finds that Act 194, Session Laws of Hawaii 2016, expanded the State's and counties' authority to condemn these roads. It also exempts, for three years, the State or county from requirements to maintain or improve roads taken by condemnation.
The purpose of this Act is for the State to pursue a means to resolve this situation by requiring the attorney general to condemn four roads.
SECTION 2. The attorney general shall take all necessary action to condemn the following roads:
(1) Auld Lane on O‘ahu, from Olomea Street to North King Street;
(2) Rawlins Lane on O‘ahu, from Auld Lane to its terminus;
(3) ‘Īao Lane on O‘ahu, from Olomea Street to Auld Lane; and
(4) Akau Lane on O‘ahu, from Hikina Lane to its terminus.
Condemnation proceedings shall be initiated no later than January 1, 2019.
SECTION 3. The attorney general shall submit a report on the status of condemnation proceedings to the legislature no later than twenty days prior to the convening of the regular sessions of 2019, 2020, and 2021.
SECTION 4. This Act shall take effect upon its approval.
