A BILL FOR AN ACT

 

 

relating to e-verify.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 103D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§103D-     Contracts with the State or counties; e-Verify required.  Purchasing agencies procuring goods or services subject to this chapter shall require, as a prerequisite to entering into any procurement contract, proof that the responsible bidder or offeror uses the e-Verify system to verify the employment eligibility of its employees.

     For the purposes of this section, "e-Verify" means an online system operated jointly by the United States Department of Homeland Security and the Social Security Administration containing information on the status of an individual's employment eligibility in the United States."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  This Act shall take effect upon its approval.
