A BILL FOR AN ACT

 

 

relating to the anger management.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that in 2009, the department of education issued a legislative report "Requesting Department of Education (DOE) and Department of Health (DOH) to jointly study the feasibility of integrating rehabilitation programs for students with anger problems", in response to House Concurrent Resolution No. 126, H.D. 1, S.D. 1, House Resolution No. 108, H.D. 1 (2008).  The report noted that currently, services for students with anger management problems are available at individual schools, where the first line of support would be a referral to the school counselor.  If the problem escalates, additional intensive supports from school-based behavioral health services may be obtained.  In addition, each school has comprehensive student support that provides a student support process for addressing the social and emotional needs of all students.

     According to the report, the current model is delivered by a private provider through a request for services.  Students must self-select to receive program services, i.e., they must recognize a problem and be willing and able to address that problem or behavior.  In addressing student behavior that results in acts of anger that may impact the school or classroom climate and other students and adults on campus, the solutions must come from within the school, through its comprehensive student support system array of services and supports.

     The purpose of this Act is to require the department of education to develop and deliver an anger management education program in each public middle or intermediate and high school.

     SECTION 2.  Part II, chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-    Anger management education.  (a)  The department shall establish and administer an anger management education program to be conducted at each public middle or intermediate and high school.

     (b)  The department shall establish the requirements for the position of an anger management education specialist and may employ at least one anger management education specialist for the purposes of this section."

     SECTION 3.  New statutory material is underscored.


     SECTION 4.  This Act shall take effect on July 1, 2011.
