A BILL FOR AN ACT

 

 

Relating to Procurement.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that greater coordination and collaboration among all interested state and federal agencies, including but not limited to the United States Department of Agriculture Child Nutrition Programs, the Hawaii department of agriculture, department of education, and department of public safety, are necessary to achieve food sustainability in Hawaii.  Crafting procurement processes within the context of the overarching goal of sustainability is also necessary to make progress toward that goal.

     The purpose of this Act is to establish a position within the state procurement office to facilitate the development and implementation of procurement processes by public agencies and private organizations to achieve food sustainability in Hawaii.

     SECTION 2.  Chapter 103D, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§103D-    Sustainable procurements manager.  (a)  There shall be established within the state procurement office a position known as the sustainable procurements manager.  The sustainable procurements manager shall assist the state procurement office in addressing the sustainability needs of various executive and legislative directives by addressing numerous sustainability issues through the procurement process, including but not limited to procuring for the State local foods for the State's schools, prisons, and hospitals.  The sustainable procurements manager shall provide administrative and procurement support statewide, provide legislative process and compliance consultation, perform historical and logistical research, lead process facilitations, and act as a policy board liaison and committee facilitator.

     (b)  The duties of the sustainable procurements manager shall include but not be limited to the following:

     (1)  To facilitate a collaborative effort among the public agencies and private organizations to develop and implement dynamic, efficient procurement processes that are customizable for statewide sustainability initiatives while ensuring procurement integrity, transparency, and oversight;

     (2)  To collaborate with various state departments and agencies on sustainability initiatives;

     (3)  To facilitate a collaborative effort among public agencies and private organizations to develop and implement associated administrative rules aligned with applicable state statutes;

     (4)  To serve as a liaison within the state procurement office to carry out policy board functions as authorized by the administrator of the state procurement office;

     (5)  To facilitate the interim and permanent rule process necessary to enable procurement for sustainable initiatives in a dynamic and efficient manner;

     (6)  To serve as a liaison between the state procurement office and sustainable initiative committees or councils; and

     (7)  To ensure compliance with any federal requirements, thereby maintaining the State's eligibility for federal funds."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2015-2016 and the same sum or so much thereof as may be necessary for fiscal year 2016-2017 to fund one full-time equivalent (1.0 FTE) position within the state procurement office to be known as the sustainable procurements manager pursuant to this Act.

     The sums appropriated shall be expended by the state procurement office for the purposes of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2015.
