A BILL FOR AN ACT

 

 

RELATING TO STATE PLANNING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the Hawaii State Planning Act was enacted in 1978 to improve the planning process and guide future development of the State.  The Hawaii State Planning Act sets forth the Hawaii state plan, which articulates goals and policies to guide the development of the State and establishes an integrated planning and implementation system regarding those goals and policies.  The last review of the Hawaii State Planning Act was initiated in 1983 and completed in 1985 and resulted in several amendments to the Hawaii State Planning Act.  Since then, there have been significant changes in Hawaii's economic, physical, and social conditions; technology; and the global marketplace.  The State also faces new constraints and opportunities as it plans for the future.  Thus, the legislature finds that a comprehensive review of the Hawaii State Planning Act, codified as chapter 226, Hawaii Revised Statutes, is now warranted.

     The purpose and intent of this Act is to review and update the Hawaii State Planning Act and continue efforts to develop goals and policies to guide the development of the State.  Specifically, this Act requires and provides funding for the office of planning, among other things, to review the Hawaii State Planning Act and report to the legislature its recommendations for updating the Hawaii State Planning Act to appropriately address the needs of the State.

     SECTION 2.  (a)  The office of planning shall review the Hawaii state plan as set forth in the Hawaii State Planning Act for the purpose of making recommendations for amendments to update the plan in response to current state needs.  Specifically, the office of planning shall further the intent and purpose of the Hawaii State Planning Act by, among other things:

     (1)  Providing recommendations on conflicts between the Hawaii State Planning Act, county plans, functional plans, and state programs;

     (2)  Reviewing major plans, programs, projects, and regulatory activities proposed by state and county agencies and providing advisory opinions and reports to the governor, as needed;

     (3)  Analyzing existing state policies, planning and program operations, laws, rules, and practices relative to the formation, implementation, and coordination of the state plan;

     (4)  Reviewing state capital improvement projects;

     (5)  Identifying and analyzing significant issues, emerging issues, problems, and opportunities confronting the State, and formulating strategies and alternative courses of action in response to the identified problems and opportunities; and

     (6)  Soliciting and reviewing proposals for amendments to the Hawaii State Planning Act from the general public in accordance with section 226-54, Hawaii Revised Statutes.

     (b)  Not later than thirty days prior to the convening of the regular session of 2017, the office of planning shall submit a written report to the legislature of its findings and recommendations, including any proposed legislation, regarding its review and proposed updates to the Hawaii State Planning Act.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $       or so much thereof as may be necessary for fiscal year 2015-2016 and the same sum or so much thereof as may be necessary for fiscal year 2016-2017 for reviewing and proposing updates to the Hawaii State Planning Act.

     The sums appropriated shall be expended by the office of planning for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2015.
