A BILL FOR AN ACT

 

 

RELATING TO DOMESTIC VIOLENCE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to establish the criminal offense of intentional, knowing, or reckless striking, shoving, kicking, or other forms of offensive touching of a family or household member as a petty misdemeanor.

     SECTION 2.  Chapter 709, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§709-    Petty misdemeanor abuse of a family or household member.  A person commits the offense of abuse of a family or household member as a petty misdemeanor if the person intentionally, knowingly, or recklessly strikes, shoves, kick, or otherwise touches a family or household member in an offensive manner or subjects the family or household member to offensive physical contact."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2030, and shall be repealed on June 30, 2022.
