A BILL FOR AN ACT
RELATING TO EMERGENCY POWERS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
"§127A- Medical facilities; elective surgeries. (a)
In the event that the governor declares a state of emergency for the
entire State or any portion thereof, or a mayor declares a local state of
emergency for the county or any portion thereof, or when the State, or any
portion thereof, is the subject of a health or pandemic emergency:
(1) The governor shall ensure the
continuity of service by medical facilities, both publicly and privately owned,
by regulating the continuation of services; and
(2) Any hospital, in its discretion, may
suspend providing elective surgeries to address operational limits of the
facility's bed capacity.
(b) As used in this section, "hospital" means a facility licensed under section 321-14.5."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on January 1, 2050.

Description:
Requires the Governor to ensure continued operation of medical facilities upon declaration of a state of emergency and during times of health or pandemic emergencies. Allows hospitals to suspend elective surgeries during the period of emergency to address the facility's bed capacity. Takes effect 1/1/2050. (SD1)
