HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING A SUNRISE ANALYSIS OF THE REGULATION OF SCHOOL PSYCHOLOGISTS.

 

 

 


     WHEREAS, school psychologists are currently exempt from chapter 465, Hawaii Revised Statutes (HRS), under which the practice of psychology is regulated; and

 

     WHEREAS, S.B. No. 224 (2017), introduced during the Regular Session of 2017, proposes to regulate the practice of school psychology by establishing licensure requirements for school psychologists; and

 

     WHEREAS, of twenty-three jurisdictions reviewed, only three jurisdictional boards license school psychologists and the departments of education, boards of education, or other credentialing bodies of the other twenty jurisdictions regulate and license or credential school psychologists; and

 

     WHEREAS, section 26H-6, HRS, requires certain regulatory measures to be referred to the Auditor for analysis if the regulatory measure being considered for enactment would subject unregulated professions and vocations to licensing or other regulatory controls upon enactment; and

 

     WHEREAS, section 26H-6, HRS, further requires that referral to the Auditor shall be by concurrent resolution that identifies a specific legislative bill to be analyzed and that the analysis shall:

 

(1)  Set forth the probably effects of the proposed regulatory measure;

 

(2)  Assess whether the enactment of the proposed regulatory measure is consistent with the legislative policies of the Hawaii Regulatory Licensing Reform Act, chapter 26H, HRS; and

 

(3)  Assess alternative forms of regulation;

 

now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2017, the Senate concurring, that in accordance with section 26H-6, Hawaii Revised Statutes, the Auditor is requested to conduct a sunrise analysis of S.B. No. 224, S.D. 2, introduced during the Regular Session of 2017, relating to the licensure of school psychologists; and

 

     BE IT FURTHER RESOLVED that the Auditor is requested to submit findings and recommendations, including any proposed legislation, to the Legislature not less than twenty days prior to the convening of the Regular Session of 2018; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Auditor.
