HOUSE CONCURRENT
RESOLUTION
URGING the Department of Public Safety and the Department of Human Services to work with the Department of Health, Department of Education, and Judiciary to submit a plan to account for gender identity WITH RESPECT TO incarcerated and court-involved youth and work with the Sexual and Gender Minority Workgroup within the Department of Health to address the incidence of LGBTQI youth in the juvenile and criminal justice systems.
WHEREAS, major mental and physical health care professional associations recognize that being lesbian, gay, bisexual, transgender, queer or questioning, and intersex (LGBTQI) is part of natural variations that occur in sex, sexual orientation, and gender identity; and
WHEREAS, the Department of Health published reports in 2018 and 2019 highlighting the issues facing lesbian, gay, bisexual, transgender, and queer or questioning (LGBTQ) children and youth in Hawaii, including higher rates of isolation, depression, suicidal ideations or attempts, substance use and misuse, homelessness, and sexual and intimate partner violence; and
WHEREAS, to date, data collection efforts indicate a significant population of indigenous lesbian, gay, bisexual, transgender, and queer or questioning youth; and
WHEREAS, intersex variation is rarely reported, leading to missed information about LGBTQI; and
WHEREAS, LGBTQI youth, particularly LGBTQI youth of color, face discrimination and stigma that can lead to criminalization and increased interactions with law enforcement and the criminal justice system; and
WHEREAS, for some LGBTQI youth, especially LGBTQI youth of color and transgender and non-conforming youth, these factors play a large role in increasing their interactions with law enforcement and ultimately their overrepresentation in the juvenile and criminal justice systems; and
WHEREAS, the primary objective of the Kawailoa Youth and Family Wellness Center, housed within the Hawaii Youth Correctional Facility, is to prevent delinquency; and
WHEREAS, the Kawailoa Youth and Family Wellness Center provides services and programs to meet the needs of youth and young adults within the criminal justice system, in addition to at risk youth outside the criminal justice system; and
WHEREAS, specific data collected on sexual orientation, gender identity, gender expression, and intersex variation intersects with the statewide anti-discrimination work and could inform decision-making processes, such as identifying the possible disproportionate impact of the criminal justice system and evaluating the efficacy of work done to alleviate obstacles unique to LGBTQ and intersex youth populations; and
BE IT RESOLVED by the House of Representatives of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2021, the Senate concurring, that the Department of Public Safety and the Department of Human Services is urged to work with the Department of Health, Department of Education, and Judiciary to submit a plan to account for gender identity with respect to incarcerated and court-involved youth and work with the Sexual and Gender Minority Workgroup within the Department of Health to address the incidence of LGBTQI youth in the juvenile and criminal justice systems; and
BE IT FURTHER RESOLVED that the Department of Health is requested to publish a comprehensive report on the health of Hawaii's LGBTQI community every three years; and
BE IT FURTHER RESOLVED that the Department of Health is requested to compare, in each of these reports, the prevalence of health-related risk behaviors, chronic health conditions, and use of preventive services between the LGBTQI population, and where possible, LGBTQI sub-populations, and the general population; and
BE IT FURTHER RESOLVED that the Department of Health is requested to post each comprehensive report on its website; and
BE IT FURTHER RESOLVED that the Department of Public Safety is requested to work with the Sexual and Gender Minority Workgroup within the Department of Health to ensure that the data collection is administered in accordance with LGBTQI data collection best practices; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor, Director of Health, Director of Human Services, Director of Public Safety, Chairperson of the Board of Education, Superintendent of Education, Chairperson of the Board of Regents of the University of Hawaii, and President of the University of Hawaii.
