A BILL FOR AN ACT
RELATING TO THE EXPEDITED AGENCY HEARING.
BE IT ENACTED
BY THE LEGISLATURE OF THE STATE OF HAWAII:
Section 1. Certain criminal activity that threatens the health and safety of the community should be expedited for review by each state agency. The purpose of this Act is to provide for an expedited agency hearing.
Section 2. Chapter 91, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§91- Expedited
agency hearing. (a) The expedited agency hearing is authorized for
any proceeding that involves:
(1) Any criminal activity
that threatens the health and safety of the community; or
(2) Any drug-related
criminal activity.
(b) The agency or party shall provide a written
request for an expedited agency hearing specifying the criminal activity and the
action or relief sought.
(c) The expedited agency
hearing shall be promptly scheduled for a time and place reasonably convenient to
both the party and the agency. A written
notification specifying the time, place, and procedures governing the hearing shall
be delivered to the party.
(d) The decision and order of the expedited agency hearing shall be in accordance with section 91-12."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
