A BILL FOR AN ACT

 

 

RELATING TO MORTGAGE FORECLOSURES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  No mortgagee shall initiate or continue with a foreclosure under power of sale under section 667-5, Hawaii Revised Statutes, or the alternative power of sale foreclosure process under part II of chapter 667, Hawaii Revised Statutes, beginning on the effective date of this Act and ending five months subsequent to the effective date of this Act.

     This Act shall not prohibit a mortgage foreclosure by action in the circuit court under section 667-1, Hawaii Revised Statutes.

     SECTION 2.  This Act shall take effect upon its approval.
