A BILL FOR AN ACT

 

 

relating to soil and water conservation districts.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 180, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§180-     Soil and water conservation districts special fund; district subaccounts.  (a)  There is established in the state treasury a special fund to be known as the soil and water conservation districts special fund.  There shall be established, within the soil and water conservation districts special fund, subaccounts for each district organized pursuant to section 180-8.

     (b)  Contributions, moneys, and funds received by any district shall be deposited into the subaccount for that district.  Funds in the subaccount of each district shall be expended for the benefit of that district and in conformity with this chapter.

     (c)  If two or more districts are consolidated pursuant to section 180-11, the corresponding subaccounts and funds shall be consolidated.

     (d)  If any district is discontinued pursuant to section 180-15, the subaccount for that district shall be abolished and any unencumbered funds shall be deposited to the credit of the state general fund."

     SECTION 2.  Section 180-16, Hawaii Revised Statutes, is amended to read as follows:

     "§180-16  Budget.  The department of land and natural resources shall submit to the director of finance, annually the budgetary estimates and information required by chapter 37, and shall include therein estimates of the financial requirements of the department.  [All contributions, moneys, and funds received by any district shall be deposited to the credit of the state general fund.]"

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
