A BILL FOR AN ACT

 

 

relating to offenses against the person.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 707-702, Hawaii Revised Statutes, is amended by amending subsection (3) to read as follows:

     "(3)  Manslaughter is a class A felony[.]; provided that if the defendant commits the offense of manslaughter by operation of a motor vehicle while under the influence of drugs or alcohol, the defendant shall be sentenced to a minimum term of imprisonment of          years."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
