A BILL FOR AN ACT

 

 

relating to dam safety.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 179D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§179D-     Maintenance and upkeep; state responsibility.  (a)  The department shall be responsible for:

     (1)  Maintaining; or

     (2)  Providing for the maintenance of,

all private dams and reservoirs within the State.

     (b)  This section shall not be construed to supersede section 179D-4."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2019-2020 and the same sum or so much thereof as may be necessary for fiscal year 2020-2021 for the maintenance and upkeep of dams and reservoirs within the State.

     The sums appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2019.

Description:

Requires the Department of Land and Natural Resources to be responsible for the maintenance of, or provide for the maintenance of, private dams and reservoirs within the State.  Maintains the State's immunity from liability.  Appropriates funds.
