A BILL FOR AN ACT
RELATING TO SHORELINE MANAGEMENT AREAS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 205A-22, Hawaii Revised Statutes, is amended as follows:
1. By amending the definition of "special management area minor permit" to read:
""Special management area
minor permit" means [an]:
(1) Development of
a single-family residence that is less than three thousand five hundred square
feet of floor area and is not part of a larger development; or
(2) An action
by the authority authorizing development, the valuation of which is not
in excess of [$500,000 and which] $750,000 with inflation adjustment
starting from the effective date of this Act and every five years thereafter by
the lead agency in accordance with the Consumer Price Index for All Urban
Consumers published by the Bureau of Labor Statistics of the United States
Department of Labor that has no substantial adverse environmental or
ecological effect, taking into account potential cumulative effects."
2. By amending the definition of "special management area use permit" to read:
""Special management area
use permit" means an action [by]:
(1) By the
authority authorizing development, the valuation of which exceeds [$500,000]
$750,000 with inflation adjustment starting from the effective date of this
Act and every five years thereafter by the lead agency in accordance with the
Consumer Price Index for All Urban Consumers published by the Bureau of Labor
Statistics of the United States Department of Labor; or [which]
(2) That may have a substantial adverse environmental or ecological effect, taking into account potential cumulative effects."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 3000.

Description:
Increases the valuation of development that determines the necessity of a special management area minor permit or special management area use permit to $750,000 and requires that amount to be adjusted every five years for inflation. Allows single-family residences that are less than 3,500 square feet in floor area and not part of a larger development, regardless of development valuation, to be eligible for a special management area minor permit. Effective 7/1/3000. (HD1)
