A BILL FOR AN ACT
relating to the counties.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to part V to be appropriately designated and to read as follows:
"§46- Exemption from liability; removal of personal property; county property. No county or county employee shall be liable to any person for the removal of personal property from county property; provided that the removal of the personal property is executed pursuant to a county ordinance that provides as follows:
(1) Prohibits persons from storing personal property on public property as determined by the ordinance; and
(2) Authorizes the removal of the personal property and its transfer to a temporary place of storage for retrieval by its owner."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
