A BILL FOR AN ACT

 

 

relating to education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part IV(B) to be appropriately designated and to read as follows:

     "§302A-     Harassment, intimidation, bullying, or cyberbullying; reporting.  (a)  The board shall adopt rules pursuant to chapter 91 to:

     (1)  Require a teacher, official, or other employee of the department to report an act of harassment, intimidation, bullying, or cyberbullying to the principal of the school at which the victim is a student;

     (2)  Identify disciplinary actions that may be taken against any teacher, official, or other employee of the department for failure to make a report as required under paragraph (1);

     (3)  Authorize a student to report an act of harassment, intimidation, bullying or cyberbullying voluntarily and anonymously to the principal of the school at which the victim is a student; provided that this paragraph shall not be construed to authorize disciplinary actions against the student solely on the basis of an anonymous report;

     (4)  Prohibit reprisal or retaliation against any person who reports an act of harassment, intimidation, bullying, or cyberbullying;

     (5)  Establish procedures to dispose of any report of an act of harassment, intimidation, bullying, or cyberbullying, including procedures for prompt investigation;

     (6)  Establish appropriate disciplinary actions to be taken against a person found to have committed an act of harassment, intimidation, bullying, or cyberbullying; and

     (7)  Establish appropriate disciplinary actions to be taken against any person found to have falsely accused another of having committed an act of harassment, intimidation, bullying, or cyberbullying.

     (b)  For the purposes of this section:

     "Cyberbullying" means the use of any electronic communication device to harass, intimidate, or bully.

     "Harassment, intimidation, or bullying" means any act that:

     (1)  Substantially interferes with a student's educational benefits, opportunities, or performance;

     (2)  Takes place on or immediately adjacent to school grounds, at any school-sponsored activity, on school-provided transportation, or at any official school bus stop;

     (3)  Has the effect of:

          (A)  Physically harming a student or damaging a student's property;

         (B)  Knowingly placing a student in reasonable fear of physical harm to the student or damage to the student's property; or

         (C)  Creating a hostile educational environment, including interfering with the psychological well-being of a student; and

     (4)  May be based on race, color, religion, sex, sexual orientation, national origin, marital status, familial status, source of income, or disability."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
