A BILL FOR AN ACT

 

 

Relating to department of education funding.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Hawaii was the first state in the nation to set aside dedicated funds every year for the acquisition and display of art in public places.  The art in public places program supports local artists and helps preserve culturally vital pieces of art.

     Currently one per cent of all capital improvement projects for state buildings are earmarked for works of art.  The average annual appropriations for the Works of Art Special Fund is about $5.5 million.  Although preserving art serves an important role, many pieces of art purchased through the special fund sit idle in storage while local classrooms are left underfunded.  Some of this money should be repurposed to teaching and inspiring the next generation of artists.

     Art education in primary and secondary schools helps students become more well-rounded.  A study from researchers at the University of Arkansas and Rice University found that students who receive art education in high school develop better critical thinking skills, and art education can lead to other positive effects on empathy and an overall desire to engage in cultural opportunities.  Art programs are often underfunded, are frequently the first to be cut from school budgets, and existing programs rarely give students adequate opportunities.  Diverting funding from the art in public places special fund to student art programs will lead to long term benefits for Hawaii's next generation.

     The purpose of this Act is to dedicate one-half of one percent of all state fund appropriations for capital improvements designated for the construction or renovation of state buildings to student art programs within the Department of Education.

     SECTION 2.  Section 103-8.5, Hawaii Revised Statutes, is amended to read as follows:

     "§103-8.5  Works of art special fund.  (a)  There is created a works of art special fund, into which shall be transferred one-half of one per cent of all state fund appropriations for capital improvements designated for the construction cost element; provided that this transfer shall apply only to capital improvement appropriations that are designated for the construction or renovation of state buildings.  The one-half of one per cent transfer requirement shall not apply to appropriations from the passenger facility charge special fund established by section 261-5.5 and the rental motor vehicle customer facility charge special fund established under section 261-5.6.

     (b)  The works of art special fund shall be used solely for the following purposes:

     (1)  Costs related to the acquisition of works of art, including any consultant or staff services required to carry out the art in public places and relocatable works of art programs;

     (2)  Site modifications, display, and interpretive work necessary for the exhibition of works of art;

     (3)  Upkeep services, including maintenance, repair, and restoration of works of art;

     (4)  Storing and transporting works of art.

     (c)  The one-half of one per cent amount, which is included in all capital improvement appropriations, shall be calculated at the time the appropriation bills are signed into law.  The moneys shall be transferred into the works of art special fund upon availability of moneys from the appropriations.  Each agency receiving capital improvement appropriations shall calculate the one-half of one per cent amount and transfer the moneys into the works of art special fund.

     (d)  The comptroller and the state foundation on culture and the arts shall decide on the specific art objects to acquire, giving first consideration to placing appropriate pieces of art at the locations of the original appropriation.

     The selection of, commissioning artists for, reviewing of design, execution, and placement of, and the acceptance of works of art shall be the responsibility of the comptroller and the state foundation on culture and the arts in consultation with the affected agency or department.

     Expenditures from the works of art special fund shall be made by the comptroller.

     (e)  The comptroller shall:

     (1)  Provide each agency receiving capital improvement appropriations with information regarding items that shall be included and excluded from the one-half of one per cent amount;

     (2)  Ensure that each agency calculates its one-half of one per cent amount correctly; and

     (3)  Ensure that each agency transfers the correct amount to the works of art special fund in a timely manner.

     (f)  The comptroller and the executive director shall track amounts due from each agency under the one-half of one per cent requirement as provided in this section."

     SECTION 3.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-    Student art programs special fund.  (a) There is created a student art programs special fund, into which shall be transferred one-half of one percent of all state fund appropriations for capital improvements designated for the construction cost element; provided that this transfer shall apply only to capital improvement appropriations that are designated for the construction cost or renovation of state buildings.  The one-half of one per cent requirement shall not apply to appropriations from the passenger facility charge special fund established by section 261-5.5 and the rental motor vehicle customer facility charge special fund established under section 261-5.6.

     (b)  The student art programs special fund shall be used solely for costs related to student art programs within department of education schools.

     (c)  The one-half of one per cent amount, which is included in all capital improvement appropriations, shall be calculated at the time the appropriation bills are signed into law.  The moneys shall be transferred into the student art programs special fund upon availability of the moneys from the appropriations.  Each agency receiving capital improvement appropriations shall calculate the one-half of one per cent amount and transfer the moneys into the student art programs special fund.

     (d)  The comptroller and the department of education shall disburse monies to schools, giving priority to schools with the highest Title I eligibility as defined in the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6301 et seq.), as amended.

     Expenditures from the student art programs special fund shall be made by the comptroller.

     (e)  The comptroller shall:

     (1)  Provide each agency receiving capital improvement appropriations with information regarding items that shall be included and excluded from the one-half of one per cent amount;

     (2)  Ensure that each agency calculates its one-half of one per cent amount correctly; and

     (3)  Ensure that each agency transfers the correct amount to the student art programs special fund in a timely manner.

     (f)  The comptroller and the superintendent of education shall track amounts due from each agency under the one-half of one per cent requirement as provided in this section.

     (g)  As used in this section, "student art programs" means curriculum, classes, or extracurricular activities including, but not limited to architecture, carpentry, ceramics, drawing, electronic art, film, painting, dance, theatre, photography, printmaking, sculpture, band, orchestra, or textiles."

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2019.
