A BILL FOR AN ACT

 

 

relating to electroconvulsive treatment.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 453, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§453-     Electroconvulsive treatment of minors; prohibited.  (a)  No physician or osteopathic physician shall engage in or attempt to engage in electroconvulsive treatment on a person under eighteen years of age.

     (b)  Any person licensed as a physician or osteopathic physician who engages in or attempts to engage in electroconvulsive treatment on a person under eighteen years of age shall be subject to disciplinary action by the Hawaii Medical Board.

     (c)  For purposes of this section, "electroconvulsive treatment" means the intentional passage of electrical current through a patient's head in a voltage sufficient to induce a seizure."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
