A BILL FOR AN ACT
RELATING TO LAHAINA SMALL BOAT HARBOR.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the Lahaina small boat ferry pier improvement project on west Maui has been in development since 2006 at least. The legislature further finds that the Lahaina small boat harbor is the busiest small boat harbor in the State, and the existing loading dock is unable to efficiently and safely support the current level and anticipated future level of usage.
The legislature additionally finds that the department of land and natural resources has proposed to build a new ferry pier approximately seventy feet north of the existing public pier at the Lahaina small boat harbor. The pier proposed by the department of land and natural resources will be approximately one hundred fifteen feet long and twenty feet wide, supported on piles. The proposed pier will include a shade roof consisting of four open sided roofed structures, fourteen feet high, connected by three open trellises on the ferry pier to shelter passengers during arrivals and departures. The proposed pier will be connected to the existing pier structure by a concrete gangway sixteen feet wide and seventy feet long. Construction of the proposed pier will also include two sewage pump-out stations, replacement of the existing harbor administration office, and resurfacing of a portion of Wharf street to facilitate safe passenger or pedestrian movement in and around the small boat harbor. The legislature further finds that this proposed pier will alleviate congestion at the public loading dock while minimizing impacts to the environment, as well as cultural and historic properties.
The purpose of this Act is to authorize general obligation bonds to be used, in conjunction with approximately $13,200,000 of federal funds, for the construction of a new ferry pier at the Lahaina small boat harbor.
SECTION 2. The director of finance is authorized to issue general obligation bonds in the sum of $ or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2017-2018 for construction of a ferry pier at Lahaina small boat harbor.
The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.
SECTION 3. The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2020, shall lapse as of that date.
SECTION 4. This project is deemed necessary to qualify for federal aid financing and reimbursement. Contractors and other third parties who receive funds under this section may be subject to review and inspection by the department of land and natural resources, the attorney general, or the auditor. Upon request by these agencies, the contractor or third party shall be required to submit for review all files, records, documents, and accounting related to the use and expenditure of funds received pursuant to this Act, whether the funds were received via contract, grant, or other agreement.
SECTION 5. This Act shall take effect on July 1, 2050.
