A BILL FOR AN ACT
RELATING TO FIREWORKS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the transportation of fireworks to, from, and within the State requires the utilization of multiple modes or methods of transport, including but not limited to interstate maritime transportation and intrastate trucking. The legislature also finds that given the diversity of transportation processes and modes, it is essential to and in the best interest of the health and safety of first responders that the importation of fireworks shipments be thoroughly accounted for and reported.
The legislature finds that current law requires licensed importers, wholesalers, and retailers to notify the county fire department when fireworks are shipped into the State. However, while the definition of "shipper" was added in statute during a previous legislative session, the requirements for shippers were not included. The legislature therefore finds that to ensure a more comprehensive tracking of all shipments of fireworks imported into the State, reporting requirements for shippers provide an additional level of safety and security.
Accordingly, the purpose of this Act is to require shippers who know of cargo that contain fireworks entering the State to report those shipments to the applicable county fire department and to authorize the applicable county fire department to inspect shipments containing fireworks or articles pryotechnic.
SECTION 2. Chapter 132D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§132D- Requirements of shippers. (a) Any shipper that has knowledge of fireworks or
articles pyrotechnic being imported into the State or transported between
counties shall notify the county fire department of the county to which the
shipment is destined, before the departure date, as to whether the shipment
will be distributed from:
(1) Pier to pier;
(2) Pier to warehouse or storage facility; or
(3) Pier to redistribution.
(b) At the time shipping is booked, the shipper
shall notify the applicable county fire department in writing of the shipment's
expected landing date.
(c) The fire department of a county in which a shipment of fireworks or articles pyrotechnic has landed and becomes subject to the jurisdiction of that fire department may, if it chooses, inspect any shipment declared on the shipping manifest as fireworks or articles pyrotechnic."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
