A BILL FOR AN ACT

 

 

relating to THE NATURAL ENERGY LABORATORY OF HAWAII AUTHORITY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 227D-2, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The governing body of the authority shall consist of a board of directors having [thirteen] nine voting members.  Three members from the general public shall be appointed by the governor for staggered terms pursuant to section 26-34, except that one of these members shall be a resident of the county of Hawaii.  The public members shall be selected on the basis of their knowledge, interest, and proven expertise in[, but not limited to, one or more] no less than one of the following fields:  finance, commerce and trade, corporate management, marketing, economics, engineering, energy management, real estate development[, property] or management, aquaculture, and ocean science[.]; provided that one public member shall have proven expertise in renewable energy and one public member shall be an owner or active manager of a business with its principal place of business located within Hawaii.  The chairperson [and secretary] of the research advisory committee shall serve on the board.  The director of business, economic development, and tourism, [the chairperson of the board of land and natural resources,] the president of the University of Hawaii, the mayor of the county of Hawaii, [an appointed] and a member from the board of the high technology development corporation[, and an appointed member from the board of the Hawaii strategic development corporation,] appointed pursuant to section 26-34, or their designated representatives, shall serve as ex officio, voting members of the board.  The tenants of the authority shall elect [two members] one member to the board from among the tenants of the authority, [of which one member shall serve a two-year term, and one member] who shall serve a four-year term[.]; provided that no tenant member shall serve on the board in excess of eight consecutive years.  In electing the tenant [members,] member, each tenant shall be entitled to cast one vote for [each] the member position.  The tenant [members] member shall be recused from voting on setting lease rents, water rates, or utility rates, but may participate in discussions.  The chairperson of the board of land and natural resources shall serve as an ex officio, nonvoting member of the board.  The director of business, economic development, and tourism shall serve as the chairperson until such time as a chairperson is elected by the board from the membership.  The board shall elect other officers as it deems necessary."

     SECTION 2.  Upon the effective date of this Act and notwithstanding section 26-34(a), Hawaii Revised Statutes, and any other law to the contrary, the terms of all the members of the natural energy laboratory of Hawaii authority's board of directors shall expire; provided that the ex officio board members and the chairperson of the research advisory committee shall continue to serve on the board.  With respect to future elections of tenant members, the limitation on duration of board membership imposed upon tenant members by section 1 of this Act shall apply to tenant members serving on the board on the effective date of this Act.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2013.

Description:

Designates the chairperson of BLNR as an ex officio, nonvoting member of the board of directors of NELHA.  Reduces the number of board members from 13 to 9.  Eliminates one tenant position, a member of the board of the Hawaii strategic development corporation, and the secretary of the research advisory committee from the board.  Limits board membership for tenant members to 8 consecutive years.  Effective 07/01/13.
