A BILL FOR AN ACT
RELATING TO THE PROBATION SERVICES SPECIAL FUND.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 353B-6, Hawaii Revised Statutes, is amended to read as follows:
"[[]§353B-6[]]
Interstate transfer fee. The judiciary may assess a fee not to
exceed $200 for each application made by a parolee or probationer for a
transfer out of the State; provided that the fees collected shall be deposited
into the [State's general fund.] probation services special fund
established in section 706-649."
SECTION 2. Section 706-649, Hawaii Revised Statutes, is amended by amending subsection (2) to read as follows:
"(2) Moneys in the probation services
special fund shall be used by the judiciary to [monitor,]:
(a) Monitor and enforce[, and
collect fees, fines, restitution, other monetary obligations owed by
defendants, and other] compliance with the terms and conditions of
probation[.] and other supervision; and
(b) Support other duties and activities related to the supervision of defendants."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2030.
