A BILL FOR AN ACT

 

 

relating to animals.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that healthy dogs and cats that have been used for testing the performance, safety, or quality of a product, or for scientific, medical, or educational research or testing, deserve to enjoy their lives and be well cared for in a humane environment upon completion of those purposes.

     The purpose of this Act is to require a research facility that intends to euthanize a dog or cat for any purpose other than scientific, medical, or educational research to make that animal available for adoption prior to euthanizing the animal if the animal is suitable for adoption.

     SECTION 2.  Chapter 143, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§143-     Adoption of dogs and cats in lieu of euthanasia.  (a)  A research facility that intends to euthanize a dog or cat for any purpose other than scientific, medical, or educational research, before euthanizing the dog or cat, shall offer the dog or cat for adoption if the dog or cat is appropriate for adoption.  For the purpose of carrying out this subsection, a research facility may offer the dog or cat for adoption through a program of the research facility or enter into a collaborative agreement with an animal shelter that performs the work of an animal rescue organization; provided that the animal shelter or animal rescue organization shall be domiciled in the State and exempt from taxation pursuant to section 501(c)(3) of the Internal Revenue Code, as amended.

     (b)  A research facility and any officer, director, employee, or agent of the research facility shall be immune from civil liability for any act or omission relating to the adoption of a dog or cat pursuant to subsection (a).

     (c)  As used in this section:

     "Animal rescue organization" means a nonprofit organization established for the purpose of rescuing animals in need and finding permanent, adoptive homes for those animals.

     "Research facility" means an organization that is engaged in:

     (1)  Animal research for the purpose of testing the performance, safety, or quality of a product; or

     (2)  Research for scientific, medical, or educational purposes."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on January 1, 2018.
