A BILL FOR AN ACT
relating to environmental protection.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
"§321- PFAS
testing grant program. (a)
There is established a PFAS testing grant program to be developed and
administered by the department of health in collaboration with the university
of Hawaii.
(b) The PFAS testing grant program shall provide funding to assist communities, businesses, and residents throughout
the State in obtaining testing services and biological sampling to identify and
detect perfluoroalkyl and polyfluoroalkyl substances (PFAS), also known as
"forever chemicals", in water, soil, dust, crops, food, packaging,
consumer products, and other substances and materials.
(c) The department of health may award grants
based on criteria that shall be developed by the department.
(d) The following standards shall apply to all
grants provided under the program:
(1) Any grant shall be used exclusively
for the purposes of the program;
(2) The grantee shall comply with all
applicable federal and state laws prohibiting discrimination against any person
on the basis of race, color, national origin, religion, creed, sex, age, sexual
orientation, disability, or any other characteristic protected under applicable
federal or state law;
(3) The grant shall not be used for
purposes of entertainment or perquisites;
(4) All activities undertaken with grant
funds received shall comply with all applicable federal, state, and county
statutes and ordinances;
(5) The grantee shall:
(A) Indemnify and hold harmless the
State and its officers, agents, and employees from and against any and all
claims arising out of or resulting from activities carried out or projects
undertaken with funds received from the program; and
(B) Obtain sufficient insurance to
provide the indemnification under subparagraph (A), if requested to do so by
the department of health; and
(6) The grantee shall agree to make
available to the department of health all records the grantee may have relating
to the grant to monitor the grantee's compliance with the requirements of the
program.
(e) The department of health shall adopt rules to
carry out the purposes of the grant program.
The grant applications shall be reviewed and approved by an administrative
staff member of the department."
SECTION 2. In accordance with section 9 of article VII of the Hawaii State Constitution and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that the appropriations contained in Act 164, Regular Session of 2023, and this Act will cause the state general fund expenditure ceiling for fiscal year 2024-2025 to be exceeded by $ or per cent. This current declaration takes into account general fund appropriations authorized for fiscal year 2024-2025 in Act 164, Regular Session of 2023, and this Act only. The reasons for exceeding the general fund expenditure ceiling are that:
(1) The appropriation made in this Act is necessary to serve the public interest; and
(2) The appropriation made in this Act meets the needs addressed by this Act.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2024-2025 for the PFAS testing grant program.
The sum appropriated shall be expended by the department of health for the purposes of this Act.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect on July 1, 2024.
