A BILL FOR AN ACT
relating to the statewide traffic code.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that traffic lights are malfunctioning with increased frequency due to power outages and weather incidents. The legislature further finds that there is confusion among drivers on how to behave in those situations.
The purpose of this Act is to define for drivers that following the right-of-way guidelines for four-way stop intersections is the correct course of action to take in intersections with malfunctioning traffic-control signals.
SECTION 2. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§291C- Inoperative signals. (a) The driver of any vehicle approaching an intersection that has inoperative traffic-control signals shall stop at the intersection, and may proceed with caution when it is safe to do so.
(b) When two or more vehicles approach or enter an intersection from different highways at approximately the same time, and the intersection has inoperative traffic-control signals, the drivers shall be subject to the right-of-way code as provided in section 291C-61."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
