A BILL FOR AN ACT

 

 

Relating to psychiatric Health Facilities.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the state is unable to provide room for individuals involuntarily committed pursuant to Hawaii Revised Statutes 343-60.2, 343-60.3, and 343-161. According to the Treatment Advocacy Center a minimum of fifty beds per 100,000 people is considered necessary to provide minimally adequate treatment for individuals with severe mental illness. Hawaii fails to meet this minimum standard.

     The legislature further finds that as a result of the shortage of space many mentally ill individuals are left to struggle to survive in our communities.  Many are homeless and unable to control their behavior.  These circumstances cause undue stress and strain on police departments, officers, and emergency medical providers.

     The purpose of this Act is to expand forensic health facilities at the Hawaii State Hospital and bring the state closer to meeting the minimally adequate standard.

     SECTION 2.  The director of finance is authorized to issue general obligation bonds in the sum of $        or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2020-2021 for the purpose of financing capital improvement projects for the planning, design, construction, and equipping of new or the expansion of existing licensed psychiatric facilities.

     SECTION 3.  The sum appropriated for the project set forth in this Act shall be expended by the department of health for the purposes of this Act.

     SECTION 4.  The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2022, shall lapse as of that date.

     SECTION 5.  This Act shall take effect on July 1, 2020.
