A BILL FOR AN ACT
relating to beaches.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§200- Beaches; operation of motorized vehicles. (a) Notwithstanding any law to the contrary and unless authorized by the board, no person shall drive or operate on any beach in the State any motorized vehicles, except on designated state or county trails and roads that are managed for motorized use; provided that the use of a motorized wheelchair by an individual whose disability requires use of a wheelchair shall not be considered driving or operating a motorized vehicle.
(b) Any person who violates this section shall be guilty of a petty misdemeanor and shall be fined:
(1) $200 for a first offense;
(2) $400 for a second offense; and
(3) $1,000 for a third or subsequent offense.
(c) As used in this section, "motorized vehicle" means a motor vehicle of any type, including automobiles, trucks, vans, off-highway vehicles such as all-terrain vehicles, motorcycles, motor bikes, mopeds, motor scooters, trail bikes, go-carts, and dune buggies, whether the vehicle is licensed or unlicensed."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
