A BILL FOR AN ACT

 

 

relating to a transitional housing center for the homeless.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that homelessness is a serious problem affecting many neighborhoods and communities throughout the State.  The lack of affordable housing and rentals has forced residents to live or sleep on sidewalks or in cars, business entrances, underpasses, and other public and private locations not meant for habitation.

     The legislature further finds that Sand Island state recreation area is near downtown Honolulu and is an underused and open space with parking, showers, and restrooms.  It is an ideal location to create a temporary transitional housing center where homeless persons can reside for up to nine months.

     SECTION 2.  (a)  The department of land and natural resources, in consultation with the office of the governor and the department of human services, shall establish a transitional housing center for homeless persons within Sand Island state recreation area on Oahu; provided that the land designated for the transitional housing center for homeless persons shall not be more than one-fourth of the total area of the Sand Island state recreation area.

     (b)  The State shall consult and coordinate with the appropriate agencies of the city and county of Honolulu, appropriate nonprofit organizations, churches, and businesses to provide necessary services for homeless persons that use the transitional housing center.

     (c)  The transitional housing center shall house up to 1,500 individuals in a maximum of six separate areas, which may be segregated for families, men, and women.  The transitional housing center housing may include tents, tiny homes, containers, or other low cost structures approved by the State.  Passenger cars and other vehicles may be parked at the transitional housing center and used for shelter.

     (d)  The department of land and natural resources or the department of human services may adopt rules pursuant to chapter 91, Hawaii Revised Statutes, to effectuate this Act.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $3,000,000 or so much thereof as may be necessary for fiscal year 2016-2017 for the establishment of a transitional housing center pursuant to this Act and its associated costs, which shall include one full-time equivalent (1.0 FTE) manager, security personnel, and two shuttle drivers and maintenance workers, and may include living units and restrooms, twenty-four hour security, shuttle service, healthcare services, one-on-one counseling, job skills training, childcare, fitness classes, nutrition education, and other social services to assist the homeless to transition into permanent housing and employment.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 4.  This Act shall take effect upon its approval; provided that section 3 shall take effect on July 1, 2016.
