A BILL FOR AN ACT
RELATING TO EDUCATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 302A-1143, Hawaii Revised Statutes, is amended to read as follows:
"§302A-1143 Attending school in what service area. (a) A person of school age shall be required to attend the school of the service area, as determined by the department, in which the person resides, unless:
(1) The person is enrolled in a Hawaiian language medium education program or charter school;
(2) A geographic exception to attend a school in another service area is requested and granted at the discretion of the department;
(3) Out-of-service-area
attendance is mandated by the department or by federal law; [or]
(4) The person is
enrolled in a career and technical education program under section 302A-1143.5[.];
or
(5) The parent of
the person has transferred or is pending transfer from another state to a
military installation in Hawaii while on active military duty pursuant to an
official military order.
(b) If subsection (a)(5) applies:
(1) The department
shall, within five days of receipt of a military order, accept an application
for school or program enrollment and course registration by electronic means,
subject to available space;
(2) The parent
shall electronically provide the department with proof of one of the following
addresses for purposes of school placement:
(A) Pending
or current occupancy in a temporary on-base billeting facility or other
temporary accommodation within the local community;
(B) An
agreement to purchase, construct, or lease a dwelling within the local
community; or
(C) Waitlisted
status or pending or current occupancy in a dwelling located within any on- or
off-base federal government housing;
(3) The parent
shall provide proof of residence and any other required documents to the
department within ten days after the arrival date provided on the official military
orders; and
(4) The person shall be permitted to continue attendance at the same school through the end of the school year if the person is relocating from temporary to permanent military housing in the State and has attended the school for at least fourteen school days."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect on June 30, 3000.
