A BILL FOR AN ACT

 

 

RELATING TO DENTISTS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 448, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§448-    Specialty license.  (a)  A licensed dentist shall not:

     (1)  Announce or hold the dentist's self out to the public as a specialist; or

     (2)  Practice as a specialist,

unless the licensed dentist has complied with the requirements of this section.

     (b)  The board shall issue a specialty license to a licensed dentist who:

     (1)  Has been certified in any specialty by an examining board recognized by the American Dental Association; and

     (2)  Submits an application for a specialty license, which shall be accompanied by an application fee.

(c)  Licensees shall be subject to the penalties set forth in section 448-17 for failure to renew the licensee's specialty license or licenses or for failure to pay the renewal fee.

(d)  As used in this section:

"Licensee" means a licensed dentist who has been approved by the board to hold a specialty license pursuant to this section.

"Licensed dentist" means a dentist who is licensed to practice dentistry in the State of Hawaii and holds a current certificate of license pursuant to section 448-13."

     SECTION 2.  Section 448-7, Hawaii Revised Statutes, is amended to read as follows:

     "§448-7  Fees.  (a)  Every applicant qualified for registration shall pay a license fee before entering practice.  Every person holding a license to practice dentistry in the State shall pay to the board on or before December 31 of each odd-numbered year, a biennial registration fee.  The failure, neglect, or refusal of any duly licensed dentist or doctor of dental surgery to pay the biennial fee during the time the license remains in force, shall constitute a forfeiture of the license.  The license may be restored upon written application therefor and the payment to the board of dental examiners of the appropriate fee.

     (b)  A licensed dentist applying for a specialty license pursuant to section 448-   shall pay an application fee upon application for a specialty license.  A specialty licensee shall pay an annual renewal fee for each applicable area of specialty pursuant to section 448-   ."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.
